Terms of Service
These terms govern your use of the cliphearth.com website and your licence to use the ClipHearth desktop application. Please read them together with the Privacy Policy and the Refund Policy.
01Who you are dealing with
The website and the software are provided by Ondřej Šumbera, Město Touškov, Školní náměstí 4, 33033, registration no. 05808685 ("we", "the operator"), who grants you the licence described below. The desktop app is made by David Štencl and Ondřej Šumbera; David Štencl is named as its publisher in the installer, in the file properties and in the app.
The seller and merchant of record for every licence bought on this website is Link, a payment service operated by Stripe. Your purchase contract, receipt, applicable taxes and any statutory right of withdrawal are handled by Link under the terms of sale shown to you at checkout. If those terms and these conflict on a matter concerning the purchase itself, the checkout terms prevail for the transaction; these terms govern the website and your use of the software.
You must give accurate details at checkout, including your country. Taxes and pricing are based on them, and the consequences of inaccurate information are your responsibility.
02The software and the free trial
ClipHearth is a desktop application for Windows 10 and later, macOS and Linux that detects media streams in its built-in browser, downloads or records media you are authorised to keep, records your screen, takes screenshots, converts between formats and edits clips, and passes files between your computers or to people you share a box with (Shared box). It bundles the media engine it needs; nothing else has to be installed.
Every copy starts in trial mode: 3 tasks per computer, without a card or an account. Each download, conversion or subtitle job is one task, and so is a screen recording over 3 minutes; screenshots and shorter recordings are free and stay free after the trial. After the 3 tasks a licence is needed to keep going, also for new episodes that Following downloads. AI subtitles and translation need a licence; subtitles that a video or website already provides also work in trial mode. Shared box is not part of the trial.
Shared box. Every computer in a shared box needs a valid ClipHearth licence, to create a box as well as to join and use one. A computer can be in up to 3 shared boxes, up to 3 boxes count for one licence, and a box takes at most as many computers of one licence as the licence has. On a computer without a valid licence its boxes pause; what already arrived stays on the computer, and the boxes work again once the licence is valid. The computer that created a box is its admin: only the admin changes the box's password, takes computers out, removes what other computers put in, changes how long the box is kept and deletes it. Anyone can leave a box. The admin can hand the role to another computer; the role also moves when the admin leaves, and another computer can take it over with the box's password once the admin has been away for 30 days. A box counts for the licence that created it; when the admin role moves to a computer of another licence, it counts for that licence from then on, unless that licence already has 3. The licence a box counts for can delete it without the box's password. The name of a deleted box that was in use can stay unavailable for a new box for 30 days. You can also lock a box on one of your computers with a password of its own: what the box keeps on that computer then opens only with that password. Nobody can recover a forgotten lock password or box password, not us either. When the computers in a box cannot reach each other directly, items go through a relay server: up to 20 GB a month per licence, while direct connections have no limit. The relay server can be unavailable or full for the month; items then travel only directly, for example on the same network. The content of a box is encrypted end to end: we cannot see or moderate it, but we can delete a box on request by its ID.
AI subtitles and translation run on your computer. The models they need are downloaded from our model server only when you choose them. Subtitles and translations created by AI can contain mistakes; check them before you rely on them or publish them.
Downloading, converting and editing happen on your computer. An internet connection is required the first time the app starts (to record your acceptance of the terms of use), for trial tasks, for activating a licence and for updates.
Licence checks. While you use ClipHearth, it confirms your licence with our activation server. When the server cannot be reached, a lifetime licence keeps working for up to 40 tasks or 30 days and a monthly subscription for up to 15 tasks or 7 days, whichever comes first. After that the app needs an internet connection to confirm the licence before it runs further licensed tasks.
03Your licence
Lifetime licence. Against a one-time payment we grant you a perpetual, non-exclusive, non-transferable licence to install and use ClipHearth on as many computers as your licence key was sold for (stated on your order). It includes every update we release. Licence checks and how long the app works without a connection are described in the section above.
Extra computers. You can add computers to a lifetime licence on the Add computers page, for a one-time payment per computer, up to 10 computers per licence. Added computers belong to that licence: they cannot be moved to another licence, and they last as long as the licence does. Extra computers are not available for a monthly subscription; switch it to lifetime first.
Monthly subscription. Against a recurring payment we grant you the same rights for each paid period. The app confirms the subscription with our server while you use it. The subscription renews automatically through Stripe until you cancel it; after cancellation it keeps working until the end of the period you have paid for.
Switching from monthly to lifetime. While a subscription runs you can buy a lifetime licence for the normal price. The lifetime licence starts when the period you have already paid for ends: those days are not refunded, nothing is charged again after that, and we cancel the recurring payment for you. Your activation key stays the same. If you refund that payment within 14 days, the lifetime licence is deactivated and we give you back the subscription days that were still unused - see the Refund Policy.
You may use ClipHearth for personal and commercial purposes. A licence is for the person or organisation that bought it. The people in your household, or a small team working with you, may use it too, on no more computers than the licence was sold for. Keep the key confidential: do not publish, resell or transfer it, and do not share it with anyone else. Reinstalling ClipHearth on the same computer keeps the licence; the app restores it by itself. To move a licence to a different computer, or after a fresh install of the operating system, contact info@cliphearth.com and we will release the old device. A computer released or removed from a licence cannot activate it again by entering the key; only our support can add it back.
You must not reverse engineer, modify or circumvent the licensing, trial or update mechanisms, redistribute the software, or remove its notices - except where the law or the open-source licences of included components expressly allow it (see Third-party notices).
04Terms of Use accepted in the app
The following text is shown at the first start of ClipHearth and must be accepted before the app can be used. It forms part of these terms and applies to everyone using the software. Current version 2026-10-25, shown by ClipHearth 1.7.1 and later:
ClipHearth is provided only for downloading, saving, converting, recording, or passing on media and files, and for creating subtitles or translations of media, that you own, created yourself, are authorized to use, or may lawfully process.
You must not use ClipHearth to download, copy, distribute, bypass access controls for, or otherwise misuse copyrighted works, private content, paid content, protected streams, or any other material unless you have the legal right and any required permission to do so.
You are solely responsible for how you use ClipHearth, including what you put in a shared box and share with other people. You are responsible for complying with applicable law, copyright rules, platform terms, license terms, privacy rules, and any other obligations that apply to the media or service you use.
ClipHearth is provided "as is" and "as available". We do not guarantee that it will work with every website, stream, file, account, service, device, operating system version, network, or future platform change. Bugs, compatibility issues, service outages, and feature limitations may occur and will be addressed over time where reasonably possible. Subtitles and translations created by AI can contain mistakes; check them before you rely on them or publish them. Nothing in these terms limits the rights you have as a consumer under applicable law.
LICENSE. ClipHearth is licensed, not sold. Without a license you may use it in trial mode for 3 tasks on this computer; screenshots and screen recordings up to 3 minutes stay free. AI subtitles and translation and shared boxes need a license. A license key activates as many computers as it was sold for. While you use ClipHearth, it confirms your license with our activation server. When the server cannot be reached, a lifetime license keeps working for up to 40 tasks or 30 days and a monthly subscription for up to 15 tasks or 7 days; after that an internet connection is needed to confirm the license again. A monthly subscription keeps working until the end of the paid period. License keys are personal: do not share, resell or transfer them. To move a license to a different computer, contact support. The first start, activation, trial use, license checks and updates require an internet connection. The full Terms of Service, Refund Policy and third-party notices are published on cliphearth.com and apply to your use of ClipHearth. Third-party components and AI models that come with ClipHearth or that it downloads are provided under their own licenses, listed in the third-party notices; nothing in these terms restricts the rights those licenses give you.
DATA. When you accept, ClipHearth sends the version of these terms, a device identifier (a one-way hash derived from your computer's machine id and user name), your platform and app version to our activation server, which also stores a hashed IP address, as proof of acceptance. Trial use and license checks send the same device identifier, platform and app version. License activation additionally sends your computer's name so you can recognise the device. Update checks send only your platform, app version and update channel. Messages you send from the Contact window include your app version, platform and device identifier. AI subtitles and translation run on this computer: the audio and the text never leave it, and the hardware details used to suggest a model stay on it too. The models they need are downloaded from our model server, which sees your IP address and app version like any download; no device identifier is sent. A shared box passes texts, pictures and files between your computers, or to people you share the box with: the content travels straight between the computers, encrypted end to end, or, when they cannot reach each other, still encrypted through the relay service of our network provider, which passes it on as it comes and keeps nothing; it never passes through or is stored on our server, and we cannot read it. When the relay is used, our activation server records which license each relay access was given to and how much data passed through the relay for that license in the month, to keep a monthly limit per license, and deletes these records after three months. For a shared box, our activation server stores a one-way hash of its ID, a proof derived from its password (never the password), its key encrypted with the password, the license it counts for (the one that created it, or the one its admin role went to), which activated computer of a license each of its computers is (and so the name that computer was activated under), and, encrypted so that we cannot read them, the names its computers give themselves in the box and the list of what was put in it; it passes on the encrypted messages with which the computers connect. The computers in a shared box learn each other's IP addresses. ClipHearth contains no analytics or telemetry. Diagnostics logging is off by default, stays on this computer and is never sent automatically. Details are in the Privacy Policy on cliphearth.com.
By continuing, you confirm that you understand these terms and accept full responsibility for lawful and permitted use of the application.

You must not use ClipHearth to download, copy, distribute, bypass access controls for, or otherwise misuse copyrighted works, private content, paid content, protected streams, or any other material unless you have the legal right and any required permission to do so.

05Prohibited use
In addition to the terms of use above, you must not:
- circumvent digital rights management or other technical protection measures - ClipHearth does not do this, and protected content is not supported;
- download, record or process content you have no right to keep, or use the software in breach of a platform's or service's terms;
- use the software to infringe anyone's copyright, privacy or other rights;
- record other people, calls or meetings without the consent the law requires, or share a recording in a way the people in it did not agree to;
- pass on through a shared box media or files you have no right to share, or use a shared box to distribute content to people who may not receive it;
- run automated or mass use of the free trial, or otherwise interfere with our activation, licensing or update servers;
- use the website or the software for anything unlawful.
06Updates, availability and third-party sites
We deliver cryptographically signed automatic updates. Updates may add, change or remove features. Websites and streaming services change constantly, so we cannot guarantee that ClipHearth will work with any particular site, stream, file or service, now or in the future.
Our servers may occasionally be unavailable for maintenance or reasons outside our control. Licence checks rely on our activation service; while it cannot be reached, the app keeps working within the allowance described under The software and the free trial. The relay server for shared boxes may be unavailable or full for the month; direct connections between the computers in a box do not depend on it.
If we ever shut down the activation service, we will first release an update that lets activated lifetime licences keep working without it.
07Your statutory rights
If you are a consumer, nothing in these terms limits the rights you have under the law of your country of residence, including your rights to conforming digital content under Directive (EU) 2019/770 and the national laws implementing it. The statutory right of withdrawal for digital content is explained and handled by Link at checkout; on top of it we offer the voluntary money-back guarantee described in the Refund Policy.
08Open-source components
ClipHearth includes open-source software, such as FFmpeg (GNU GPL v3), yt-dlp with the libraries it bundles, libVLC and LibVLCSharp (GNU LGPL v2.1), GtkSharp (GNU LGPL v2.0), libraries under the MIT, BSD and other permissive licences, and the ad, tracker and cookie filter lists of the EasyList project under Creative Commons licences. Their licences grant you rights that these terms do not restrict. The full list, the licence texts and where to obtain the source code are on the Third-party notices page and in the licenses folder shipped with the app. AI models that ClipHearth downloads are provided by their authors under their own licences (MIT for Whisper and Silero VAD, Apache 2.0 for Hy-MT2), listed on the same page. Some components are licensed to us for distribution with ClipHearth only, such as the Microsoft Visual C++ runtime in the Windows version: use them only as part of ClipHearth, and do not copy them separately, modify them or reverse engineer them, except where the law allows it.
09Refunds
Lifetime licences and extra computers come with a 14-day money-back guarantee, and each payment is refunded on its own; monthly subscriptions can be cancelled at any time. Details, including what happens to your licence key and its computers, are in the Refund Policy.
10Termination and revocation
You may stop using ClipHearth at any time; a subscription is cancelled through the link in your Stripe receipt or by writing to us.
We may revoke a licence key, without refund where a breach is involved, if:
- the purchase is refunded, charged back or found to be fraudulent (revocation is automatic in these cases);
- the key is published, resold, or shared beyond your household or team, or used on more computers than licensed;
- the software is used in breach of these terms or of the terms of use accepted in the app.
11Warranty and liability
ClipHearth is provided "as is" and "as available" to the extent permitted by law. Keep copies of important files: exports are written as new files unless you choose to change the original (for example when you add subtitle tracks to a video), but we cannot be responsible for loss of data on your computer.
To the extent permitted by law, our total liability for all claims relating to the website or the software is limited to the amount you paid us for the licence in the 12 months before the claim, and we are not liable for indirect or consequential loss, lost profits or lost data. Nothing in these terms excludes or limits liability for intent or gross negligence, for death or personal injury, or where such limitation is not permitted by applicable law, including consumer law.
12Governing law and disputes
These terms are governed by the law of the Czech Republic. If you are a consumer, you also keep the protection of the mandatory rules of the country where you live. Disputes are decided by the competent courts of the Czech Republic, unless consumer law gives you the right to sue elsewhere.
These terms are written in English, and the contract is concluded in English. ClipHearth may show summaries or translations of them in other languages; if they differ, the English text applies.
Consumers may use out-of-court dispute resolution with the Czech Trade Inspection Authority (Česká obchodní inspekce, coi.cz). We would rather solve any problem directly - write to info@cliphearth.com first.
13Changes and contact
We may update these terms; the version and date at the top show when. Material changes to the terms of use shown in the app take effect for you when you accept the new version at the app's next start. Questions: info@cliphearth.com.
